Well Scooter Libby is on his 3rd defense before his trial which is set for 2007. His 1st was to greymail the govt, by which requesting tons of classified documents which the WH won't give up thus causing a mistrial since he can't defend himself. Fitz stopped that one with a letter to the judge explaining the tactic. His 2nd defense came as a "I'm sorry, I simply forgot, I'm too busy of a person to know that I just outed a CIA agent". That one bombed and now we are onto the 3rd defense. Scooter is now pushing for the case to be thrown out on the grounds that Fitz was not appointed by the prez. Since Ashcroft recused himself from the case for being too close the Assistant AG stepped in and appointed the special council. Libby's laywers are now saying that was illegal and the case should be thrown out. Its only February, I wonder how many more excuses they will come up with before the trial.

“In a court filing, lawyers for I. Lewis “Scooter” Libby said the indictment violates the Constitution because Special Counsel Patrick Fitzgerald was not appointed by the president with the consent of the Senate.”
